Tim Holman’s article, “Act 95: Pennsylvania’s New POA Law – A View From The Fiduciary Litigation Trenches,” was just published in the Philadelphia Bar Association Probate and Trust Law Section Newsletter.  The article discusses such issues as whether you will be immune or liable for accepting a Power of Attorney and following an Agent’s instructions, and whether you should draft your Power of Attorney documents to confer standing upon third persons to review an Agent’s conduct during the Principal’s lifetime.
